1. General
conditions
1A. Sending an order to BYN means the acceptance
by the client of these legal conditions. No condition sent by the customer
can be different from the ones expressed by BYN unless it has been
previously accepted and confirmed in written by BYN

not definitive till it has been accepted by BYN
2.
Prices
2.1. Published prices are valid except there is a
printing mistake. Prices with VAT included. Shipping costs not
included.
3. Payment conditions
3.1. The
products will be paid by credit card or bank transference under the
conditions that BYN agrees with the client.
4.
Shipments
4.1. BYN will not send any product till BYN
accounts dept. has confirmed that payment has been sent or that the request
to pay for instalments has been accepted.
4.2. Delivery is considered
to be made when the transport company has delivered the products to the
client and the client has signed a document confirming the delivery. Client
must check the products upon receipt and write any justified claims in the
document of confirmation of delivery.
4.3. BYN does not compromise to
urgent shipments. Delivery times mentioned by BYN are rough and BYN will
take all the measures to respect them. However a delay will not mean the
cancellation of the order neither a compensation for delay. Any penalty
clause for delay written by the client in his order will not be valid
following what is mentioned in point 1.1. of these legal
conditions.
4.4. BYN will always try to send the orders by national
transport companies. However, BYN keeps the right to use any other way of
transport if it should be necessary to fulfil its compromise.
- The price of a shipment for a complete order to any place in Spain will be of 7
EUR, orders over 30 EUR will not pay transport cost (Vat included)
- The price of a shipment for a complete order to any country in EU and
Andorra, Norway, Switzerland, Monaco and Vatican will be of 17 EUR, orders over 50 EUR will not
pay transport cost (Vat included)
- The price of a shipment for a
complete order to any place in the rest of Europe and America will be of 24 EUR, orders over
100 EUR will not pay transport cost (Vat included)
- The price of a
shipment for a complete order to any place in the rest of the world will be
of 30 EUR, orders over 200 EUR will not pay transport cost (Vat
included)
4.5. BNY keeps the right to send the orders in
instalments.
4.6. The conditions of sale, on sales made on the Blanco
y Negro Music, S.A. web site are according to the Incoterm DDU (Delivery &
Duties Unpaid). This means that the delivery charges, are included but not
any costs which are derived from customs clearance, these costs must be paid
by the receiver of the goods.
5. Returns
5.1.
BYN will not accept any claim after 15 working days on invoice
date
5.2. BYN will only accept returns for defective material and in
that case BYN will send the same product again in perfect
conditions.
5.3. BYN will not accept returns if the packaging of the
product is not the original one and these are not kept in perfect
conditions. The original packaging must be protected in the way that the
product is received in perfect conditions, and it is forbidden the use of
seals and adhesive tapes.
5.4. Any return must be authorised by BYN.
To do so the customer must request to BYN with an e-mail to
tienda@blancoynegro.com a return number authorisation (RMA number)
mentioning the reason for the return and invoice number.
5.5. Once
the client has received the RMA number, he wil send the products to the
address mentioned by BYN. Costs of this transport will be paid by the
client.
6. Guarantees
6.1. All the products
that BYN sells have a guarantee period mentioned in the product or what the
manufacturer establishes (in this case it is the manufacturer who takes care
of the guarantee of the products).
6.2. The guarantee will not be
valid under the following situations:
- Blows and/or innapropriate
transport
- Damages due to natural catastrophes like storms, floods,
lightnings, earthquakes, fires, etc.
6.3. All the controls during the
guarantee period will be made in BYN offices.
6.4. When the client
has received the RMA number, he must pack the products correctly and will
send them to the address mentioned by BYN. Costs of this transport will be
paid by client.
7. Limitation of
responsability
7.1. THE DETAILS GIVEN IN THIS SITE BY BYN
ARE ONLY FOR INFORMATION AND FOR THIS REASON BYN DOES NOT ACCEPT ANY
RESPONSABILITY ON ITS CONTENTS (LIKE IT COULD BE THE ADAPTATION OF A PRODUCT
FOR A CONCRETE PURPOSE). ALSO BYN DOES NOT GRANT THAT THE INFORMATION
PROVIDED IN THIS SITE IS RELIABLE, COMPLETE OR UPDATED.
7.2. BYN is
not responsible of the contents of other webs linked to this site. The risks
derived from checking those pages correspond exclusively to the client who
will have to follow the terms and conditions for using them.
7.3.
Prices, qualities, and availability of the products sold by BYN can change
without warning.
8. Force Majeure
8.1. The
parties will not fall into any responsability due to any fault caused by
Force Majeure.
9. Submission
9.1. BYN hopes
that any disagreement that may arise can be solved in a friendly way. If
this is not possible, the client is expressly submited to the jurisdiction
of the Courts of Barcelona to be solved. |
